VIRGINIA BEACH, Va. (WAVY) — The trial over the residency of Virginia Beach Councilman David Nygaard is continuing for a second day.
Former Councilman John Uhrin rested his case Friday against Councilman David Nygaard. Uhrin filed a lawsuit against Nygaard in December, claiming the current Beach District councilman did not live in the district — and is therefore ineligible to serve.
Nygaard won the seat over Uhrin — who was seeking reelection — by a narrow margin following last November’s election and a subsequent recount.
A three-judge panel will decide if Nygaard lived in the district when he registered to represent the area.
Nygaard said he was in the process of switching over his address and everything was approved.
