CAMDEN COUNTY, N.C. (WAVY) — A Camden County judge approved a civil restraining order against an Elizabeth City police officer on administrative leave.
David Sutton, Jr. was charged earlier this month with two counts of injury to personal property.
Those charges were filed by a woman claiming to be his fiancée after she says he broke her $40 Brita water filter and caused $200 worth of damage to her car after ripping off her windshield wipers.
She also filed a temporary restraining order, which the judge approved on Monday.
Court paperwork lists that Sutton and the woman can have no contact or post anything about each other on social media.
Sutton can also not threaten, assault, harass the plaintiff or her family, according to court documents.
The paperwork also stated the woman was granted full custody of their infant but Sutton will have supervised visitation through the plaintiff’s parents.
Sutton’s criminal charges have been continued for six months and could be dismissed if he follows the rules of the restraining order, attends treatment programs and anger management counseling, and pays the plaintiff $500 in restitution.
If he violates the restraining order he will be held in contempt of court.
The restraining order lasts a year.
Both parties declined to comment.
The Elizabeth City Police Department did not have any further updates on their own internal investigation.
Sutton, Jr. is on unpaid leave.
