NORFOLK, Va (WAVY) — A babysitter charged in the death of an 18-month-old was back in court on Tuesday.
Ashadiya Brooks is charged with second-degree murder.
Investigators say the baby was in her care last year on October 23 when it was found unresponsive. The child, named Amir, died at CHKD two days later.
The officer who was there the day the emergency call was made was in court on Tuesday. He said it was Brooks who told him that the child was always lethargic in her care.
On this particular day, the child was laying on the couch all day sleeping up until she noticed something wrong with him.
Later when Detective Cogswell testified, he noted a similar story told by Brooks initially. Later she changed her story, saying Amir fell over and hit his head on the tile flooring while playing. He says she told him she suffered from memory loss.
Then Amir’s mother took the stand, struggling to fight back tears. She says her 18-month-old was healthy, smart and growing rapidly just as a child should. She says the day she dropped her son off with Brooks he was awake, he had eaten breakfast and was alert when she handed him off. That would be the last time she saw her son alive.
Finally, Michelle Clayton, the medical director of CHKD’s Child Abuse Program took the stand.
She described in great detail from the time the child entered the hospital up until the moment he died, two days later. The autopsy showed how his brain injuries were severe and that one fall would not bring about such trauma.
The family, including Amir’s parents were present in court. They were all wearing green ribbons in support of Amir. 10 On Your Side asked them for comment, but they all denied.
Brooks will continue to stay in custody, and a grand jury is scheduled to hear her case on April 3.
