NORFOLK, Va. (WAVY) — A man who was convicted on multiple charges in connection to the death of a 2-year-old child in Norfolk will serve 10 years in prison.

Two-year-old Evalynn Martin died three days after she was found unresponsive at a home on Lexington Street in May 2017.

Destany Martin, Evalynn’s mother, and her boyfriend, 25-year-old Robert Griffis, were both initially charged with felony counts of child abuse, child neglect and malicious wounding.

Griffis was found guilty in August on two counts each of malicious wounding and child neglect and abuse. Jurors recommended a 35-year sentence for Griffis — 10 years for each malicious wounding count, 10 years for one of child neglect charges and five years for the second.

A judge vacated the child neglect charge with the 10-year recommended sentence after a motion was filed in January.

The Office of the Norfolk Commonwealth’s Attorney said Friday a judge formally sentenced Griffis to 25 years in prison, but will serve that time concurrently.

Martin pleaded guilty in August to an amended charge of contributing to the delinquency of a minor. She received a suspended sentence for the misdemeanor charge, for two years conditioned on uniform good behavior and completion of parenting classes.
