VIRGINIA BEACH, Va. (WAVY) — A man has been found guilty of attempted aggravated murder after shooting at a Virginia Beach police officer in a Kohl’s parking lot.
According to the Virginia Beach Commonwealth’s Attorney Office, Tyler Lynn Davis, 26, arrived at Kohl’s in Pembroke Mall with three other individuals, Jaclyn Anderson, Hayley Fernandes and Brandon Foster, on Oct. 20, 2023. Davis, Anderson and Fernandes each grabbed a shopping cart and loaded up hundreds of dollars’ worth of merchandise including shoes, clothes and suitcases.
Foster walked a lap around the store and exited through a different door from where they entered. He then waited in a van in the parking lot, frequently looking around.
A Loss Prevention Officer from Kohl’s observed the suspicious activity on surveillance video and alerted police. Kohl’s staff then covered all the exits as Davis, Anderson and Fernandes attempted to leave with stolen merchandise, but Davis managed to leave through a fire escape and ran towards the van.
An officer with the Virginia Beach Police Department drove into the parking lot and was shot at three times upon exiting the vehicle by Davis. While the officer was not struck, one of the bullets struck the police vehicle which was just inches away from the officer. Davis then fled across Virginia Beach Boulevard and the officer pursued him on foot.
Ultimately, Davis was apprehended outside a restaurant in the Town Center area. Officers also retraced his path and found his gun on a median.
In an interview with detectives, Davis admitted to stealing from Kohl’s, shooting at the police officer and fleeing from police.
Fernandes, Anderson and Foster were also charged and convicted for their participation in the shoplifting incident.
Davis was found guilty of attempted aggravated murder of a law enforcement officer, use of a firearm, grand larceny and conspiracy to commit grand larceny following a three-day trial. He will be sentenced on Feb. 12, 2026.
