PORTSMOUTH, Va. (WAVY) — WAVY has confirmed the charges against a man suspected in the fatal shooting of another man in Portsmouth in the summer of 2021 have been nolle prossed.
20-year-old Xavier Elliott faced charges of first-degree murder and use of a firearm in the commission of a felony.
The charges were handed down more than a year after the shooting incident at the intersection of Aylwin Road and Connor Place on July 1, 2021. When they got to the scene, officers found 33-year-old Rickey Grant who was pronounced dead on the scene.
On October 11, 2022, court documents show both the first degree murder and firearm charge were nolle prosequi, or withdrawn. This means the prosecution will no longer prosecute Elliott on the charges.
