KITTY HAWK, N.C. (WAVY) — Police have charged the driver they say hit and killed a couple walking along the shoulder of N.C. 12 in Kitty Hawk Monday.
81-year-old David Archer, of Kill Devil Hills, has been charged with driving left of center and two counts of misdemeanor death by motor vehicle.
Investigators say Archer either fell asleep or had a medical issue around 2:30 p.m. on April 1, causing his vehicle to veer over the shoulder and hit a group of people walking along the side of the road. Alan and Holly Nicolette of Mechanicsville, Virginia were hit from behind and later died from their injuries. A child who was also injured has been released from the hospital.
The Kitty Hawk Chief of Police Joel Johnson said it was determined alcohol was not a factor in the crash and there was no evidence of malice. “This is a very unfortunate and sad incident and we ask that you please pray for the families and friends of the victims during this difficult time,” Chief Johnson said in a news release.
