VIRGINIA BEACH, Va. (WAVY) — A man who told police he felt a “little bit intoxicated” following a 2017 crash that seriously injured two people will serve seven years in prison.

The Office of Virginia Beach Commonwealth’s Attorney Colin Stolle said Carl Jordan Hylton was sentenced Monday to 10 years and 12 month, with four months suspended.

Hylton, 38, of the 200 block of West 30th Street in Norfolk, pleaded guilty to charges of DUI – victim permanently impaired (two counts) and DUI in late-April.

Prosecutors said evidence would have shown that Hylton crossed over the solid double yellow lines on Greenwich Road on Sept. 10, 2017, hitting an SUV with four young women inside.

At the time, the women were on their way home from celebrating one of their birthdays. The two backseat passengers suffered permanent injuries in the crash, according to prosecutors. 

One of the women was unconscious following the crash, and crews had to use the “Jaws of Life” to cut her out of the SUV. She spent 11 days in a coma following the crash, and diagnosed with a closed head injury, severe traumatic brain injury, and diffuse axonal injury.

Prosecutors said she was taken to a hospital in Georgia after waking up, where she underwent rehabilitation for another 11 days. Since that time, she has lived with her parents and requires 24-hour supervision.

The other backseat passenger suffered a broken hip and fractured cheek bone in the crash, according to prosecutors. She underwent surgery after the crash, and had a metal rod inserted into her hip.

She spent five days in the hospital, used a walker for six weeks and has permanent scarring.

When police arrived on scene last September, they found Hylton was not wearing a seat belt. Officers also found an open container of beer in the center console, and that Hylton had a strong odor of alcohol on his breath.

Hylton was taken to the hospital with injuries to his arm and foot. Prosecutors said Hylton told police he was coming from the beach at the time of the crash, and that he had “a little bit of alcohol,” felt “a little bit intoxicated.”

Prosecutors said hospital records showed Hylton’s blood/alcohol level was .12 — which is .04 above Virginia’s legal limit. In a search of Hylton’s car, police found three open cans of beer, two of which were 24 oz.

An open bottle of Hennessy Cognac was also found behind the driver’s seat, according to prosecutors.

Hylton had prior convictions on multiple charges, including possession with Intent to distribute marijuana, reckless driving and nine counts of driving on a revoked license.
