HAMPTON, Va. (WAVY) — A man was shot multiple times and was killed on Burton Street in Hampton Monday afternoon, police said.

Hampton Police are investigating the fatal shooting in the 800 block of Burton Street, as officers got reports of the shooting around 12:58 p.m. and found a man, later identified as 52-year-old Larry Smith, suffering from multiple gunshot wounds. Smith was pronounced dead at the scene.

A preliminary investigation indicates that Smith and the suspect, later identified as 21-year-old Da’Quan Jones, engaged in a verbal altercation after encountering each other walking on Burton Street. Police confirm that this altercation then led to the shooting. 

Police have since arrested Jones and charged him with second-degree murder, use of a firearm while in commission of a felony, reckless handling of a firearm and willful discharge of a firearm in public.

Teresa Bailey told 10 On Your Side that the suspect in this shooting is her grandson, and the man who died is her abusive ex-boyfriend. Bailey said she had a temporary restraining order on the victim earlier this year after he allegedly gave her a black eye.  

“For the last couple of years, I’ve been trying to get rid of him, to leave me alone so we don’t have this problem,” Bailey said. “I just had a restraining order on him. I took the restraining order off because I wasn’t expecting, I wasn’t in threat of my life.” 

Bailey showed 10 On Your Side a document that detailed when she said they were trying to get another restraining order against the victim Sunday, because of how the victim was now allegedly acting towards her grandson.  

“I went to the magistrate’s office after the police didn’t show up to lock him up for disorderly conduct,” Bailey said. “I wrote a statement stating that he was threatening my grandson. He wanted to fight and all of that. The magistrate told me that if he didn’t do no bodily harm to me, I couldn’t get a restraining order on him.” 

Bailey then said she had tried to tell the victim to stay away from her before the shooting happened, but she said he still ended up in her neighborhood Monday morning.  

“I think he was coming to my house, but my grandson had walked to the store, and he was coming back to my house,” Bailey said.  

Lorenzo Jones said he is the suspect’s father and said what happened Monday was self-defense. 

“He fired because he was in fear for his life with somebody running up on you, you don’t know what they’re about to do to you,” Jones said. “Everybody that knows him knows what type of person he is. He don’t harm nobody for no reason. This man was trying to hurt my child, and that’s why he fired his firearm,” 

Jones added all this could have been prevented.  

“If they would have granted her the restraining order that they denied her [Sunday], this wouldn’t have happened,” Jones said.
