HAMPTON, Va. (WAVY) — Cory Bigsby, through his attorney, filed an appeal earlier this month to the final judgement of the court made last month in connection to his child neglect charges.
The appeal was filed June 12, after the final judgement of the court came May 16.
Bigsby faced 24 counts of gross, wanton or reckless care of a child, four counts of child abuse and neglect leading to serious injury and two counts of failure to secure medical attention for an injured or battered child.
The charges were nolle prossed, or set aside, in May, because the primary witness, who was four and five-years-old at the time of the offenses, is currently undergoing therapy as a result of Bigsby’s actions.
Virginia law states a request can be made to expunge charges that are nolle prossed from record, but the decision can’t typically be appealed.
Bigsby is currently serving a 45-year-sentence in prison after being found guilty of second-degree murder and hiding his dead son’s Codi body June 18, 2024.
