PORTSMOUTH, Va. (WAVY) — A trial date for a former Churchland High School teacher accused of sexually assaulting a minor was continued to mid-June during a hearing Monday.

Jarvis Green, 34, was arrested in January of 2025 and charged with two counts of indecent liberties with a child in a supervisory role, two counts of sodomy and two counts of contributing to the delinquency of a minor.

While in court on Monday, Green’s lawyer, Michael Massie, recommended that the case be dismissed. He said the Portsmouth Commonwealth’s Attorney’s Office failed to send him discovery, which allows for both parties to know prior to the start of the trial what evidence may be presented in court.

Massie stated he requested to see the evidence against his client in late-February. As of Monday morning, the Portsmouth Commonwealth’s Attorney’s Office has yet to send Massie the evidence.

The Commonwealth said they never got the email, however, Massie brought a copy of the request he sent, saying he came prepared because of the office’s history of “disingenuous” recounts of discovery orders. Due to this, Massie recommended that the case be dismissed.

The trial was instead continued to June 18 on the condition of Massie receiving the discovery by May 5, 2025.
